General Terms and Conditions (GTC) of Shogun Sports (Europe) GmbH

  1. Scope

These General Terms and Conditions (GTC) apply to all orders, deliveries and services concluded via the online shop shogunsports.ch, by telephone, in person on site or with a field representative and/or by email.
By ordering goods or services, the customer accepts the following conditions.

  1. information

Images of products in advertisements, brochures, online shops, etc. are non-binding. The information about products in the online shop is compiled in the most customer-friendly way possible, but is not binding.
The prices in the online shop cannot be declared binding due to certain incorrect information, product changes, price changes or errors and are therefore subject to change.
Prices are net, in Swiss francs for Switzerland and in EURO for the European market and are in all cases exclusive of VAT.
Shogun Sports (Europe) GmbH reserves the right to adjust prices at any time. The price in the online shop at the time of the order is decisive.

  1. Availability and delivery times

The availability of products and the delivery times indicated are not binding. If a product is not available, the customer will be informed immediately. The company reserves the right to change delivery times or cancel orders if products are not available.
If an item in the range is exceptionally not available, the customer will be informed immediately if it has not already been noted on the order confirmation.
Shogun Sports (Europe) GmbH attaches great importance to providing current and accurate information on availability and delivery times.
However, all information regarding availability and delivery times is without guarantee.

  1. Conclusion of contract

The purchase contract is concluded when the company sends an order confirmation by email. Orders placed via the online shop, by telephone or by email are considered an offer to conclude a purchase contract.
The arrival of an online order is notified to the customer at the email address they provided. Receipt of the automatically generated order confirmation does not constitute a promise that the products can actually be delivered. It simply shows the customer that the order placed has arrived at the online shop and that the contract has therefore been concluded subject to the condition that delivery is possible and the price is correct.

  1. Delivery dates

Delivery dates are non-binding unless they have been expressly agreed as binding in writing. Delays in delivery that are beyond the control of the company do not entitle the customer to terminate the contract or to claim damages.
If the goods are available from the Shogun Sports (Europe) GmbH warehouse, the ordered goods will be delivered within 2-7 working days after payment has been made. If Shogun Sports (Europe) is late in delivering, the customer has the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date. If this is the case, Shogun Sports (Europe) GmbH will refund any amounts paid in advance. There are no further claims against Shogun Sports (Europe) GmbH.

  1. Shipping costs

The shipping costs are displayed during the ordering process and are to be borne by the customer. In the case of partial deliveries, the shipping costs are only charged once.

  1. Taxes in the receiving countries

The customer is responsible for paying all applicable taxes, duties and other charges in the receiving country.
Shogun Sports (Europe) GmbH rejects any such surcharges.

  1. Audit obligations

The customer must immediately check delivered or picked up products for accuracy, completeness and delivery damage.
The customer is granted a period of 7 working days from receipt of the goods within which he can return the goods to Shogun Sports (Europe) GmbH together with a written complaint of defects.

  1. Payment options

The company accepts the payment methods indicated in the online store. Payment is due in advance unless otherwise agreed.

  1. Retention of title

The goods remain the property of the company until full payment has been made. In the event of late payment, the company is entitled to withdraw from the contract and reclaim the goods.
Shogun Sports (Europe) GmbH is entitled to make a corresponding entry in the retention of title register. Prior to transfer of ownership, pledging, transfer by way of security, processing or modification is not permitted without the express consent of Shogun Sports (Europe) GmbH.

  1. Discount codes

Shogun Sports (Europe) GmbH provides discount codes for specific purposes. As a rule, only one discount code, regardless of type, can be redeemed for a purchase. Cash payment of your corresponding discount is not possible.
The discount code may not be changed or copied by the purchaser. Any distribution or publication of discount codes and/or links is prohibited.

12. Returns and return rights

The customer has the right to return the goods within 14 days of receipt without giving any reason. The return shipment is at the customer's expense, provided that the goods delivered correspond to those ordered. The right of return does not apply to used or damaged goods.

  1. Incorrect deliveries

Should the customer receive an incorrect delivery, Shogun Sports (Europe) GmbH undertakes to deliver the correct goods promptly and at no additional cost. The customer is obliged to return the incorrectly delivered goods.

  1. Defective items

In the case of defective goods, the customer has the right to repair, replacement delivery or refund of the purchase price. The company reserves the right to determine the chosen form of subsequent performance.
In principle, termination of the contractual relationship will not be permitted in the event of the above-mentioned occurrences.

  1. Transport damage

Transport damage must be reported to the company immediately after receipt of the goods. The customer must ensure that the delivery is checked for transport damage upon receipt and that any damage is documented directly with the supplier and the transporting company.

  1. Guarantees

The statutory warranty claims apply to products sold by Shogun Sports (Europe) GmbH. Any additional guarantees must be agreed in writing. The warranty claim becomes valid from the date of delivery.

  1. Liability and disclaimer

Shogun Sports (Europe) GmbH hereby expressly points out that no liability claims can be made against Shogun Sports (Europe) GmbH. In particular, accidents, etc. that arise from handling the items are the responsibility of the buyer.
If you have any questions or concerns about correct handling, etc., the team at Shogun Sports (Europe) GmbH is always happy to provide advice.
Furthermore, Shogun Sports (Europe) GmbH is not liable for damages resulting from any of the following causes:

  • Improper, contractually or illegal storage, adjustment or use of the products. Use of incompatible spare parts or accessories (e.g. carabiners).
  • Failure to maintain and/or improper modification or repair of the products by the customer or a third party.
  • force majeure, in particular elemental damage, moisture, falls and impact damage, etc., for which Shogun Sports (Europe) GmbH is not responsible, and official orders.

Furthermore, we assume no liability for the accuracy, completeness or legality of data collected, processed or provided by third parties as part of our online platform. This applies in particular to personal data, transaction data and other information collected and processed by third parties, such as payment service providers, shipping companies or external service providers. The responsibility for compliance with data protection regulations and the proper collection and processing of this data lies exclusively with the respective third party provider. We are not liable for damages resulting from the use or processing of such data, unless we caused the damage intentionally or through gross negligence.

All content (text, images, logos) on the company's website is protected by copyright. Any reproduction, distribution or other use requires the express written consent of the company.

  1. Data protection

The company undertakes to protect customer data in accordance with the applicable data protection regulations. The data will only be used for the purpose of executing the contract and will not be passed on to third parties unless this is necessary to fulfill the contract. 

  1. Jurisdiction and applicable law

The place of jurisdiction is the registered office of Shogun Sports (Europe) GmbH in Switzerland. Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
All legal relationships between Shogun Sports (Europe) GmbH and the customer are subject to Swiss substantive law. Cham applies to consumer lawsuits. In all other cases, Winterthur is the exclusive place of jurisdiction.

Severability clause
If any provision of these Terms and Conditions proves to be invalid, the remaining provisions shall remain
Provisions remain unaffected.
